Synopsis:

This masterclass will focus on an often underappreciated, but critical part of international arbitration – interest on amounts awarded. It will treat the subject from two perspectives – crafting persuasive and effective interest submissions, and deciding on those submissions (correctly!).

The masterclass will be given by Jonathan Ellis of HKA in Singapore, a leading quantum expert and Dr Matthew Secomb, a partner at White & Case in Singapore (author of Interest in International Arbitration (2019, OUP)).

Among other things, the masterclass will consider:

- The law applicable to interest, and the conflicts of law issues that attach to it

- Various laws’ approach to interest (common law, civil law, shari’a law)

- The economics of interest, and the economic arguments that can be used on interest

The elements of interest (rate, dates and calculation method)

- Interest as an element of damages

About the Speakers

 

Jonathan Ellis

Mr. Jonathan Ellis - Partner, HKA, Singapore

Mr. Jonathan Ellis is a partner at HKA and is based in the Singapore office. He specialises in the quantification of damages and valuations, in particular in dispute contexts. He has worked on matters before the UK and Singapore High Courts as well as in ad hoc, SIAC, LCIA, ICC, HKIAC, UNCITRAL and ICSID arbitration forums.
He has provided oral testimony on a number of occasions, in both court and arbitration, and has been engaged as a tribunal appointed expert. Since 2017, Jonathan has been recognised among the leading arbitration expert witnesses worldwide by Who's Who Legal, where he has been classified as a “Global Elite Thought Leader” and a “National Leader” in the inaugural Southeast Asia Arbitration list.

 

Matthew Secomb

Dr. Matthew Secomb – Partner, White & Case Pte Ltd

Dr Matthew Secomb is a partner based in White & Case’s Singapore office and heads the firm’s International Arbitration Group in the Asia-Pacific. His practice focuses on international arbitration, with a particular emphasis on energy and construction disputes. He also acts as arbitrator, having chaired or sat as sole or co-arbitrator in arbitrations under various rules (ICC, HKIAC, LCIA, SIAC etc). Matthew is qualified as an avocat à la cour at the Paris bar, a solicitor-advocate in England & Wales and a barrister and solicitor in Victoria. He teaches an annual course on Energy Arbitration as an Adjunct Associate Professor at NUS Law. Matthew is listed in Who’s Who Legal: Global Elite Thought Leaders 2023 – Arbitration.

About the Moderator

Matthew Shaw

Mr. Matthew Shaw – Counsel, Mayer Brown PK Wong & Nair Pte Ltd

Matt Shaw is counsel in the International Arbitration practice in Mayer Brown’s Singapore office.
Matt has more than 15 years of experience of international commercial arbitrations in Asia and across the world. He focuses on cross-border disputes arising in a range of sectors including technology, financial services, energy and construction, and has notable experience in disputes involving intellectual property, private equity funds and major national infrastructure projects.
Matt has advised and represented clients as lead advocate under the rules of most of the world’s leading arbitral institutions, including the ICC, SIAC, HKIAC, LCIA, BANI and VIAC. He also has acted for clients in arbitrations in many of the world’s key arbitral seats including London, Paris, Zurich, New York, Washington, D.C., Singapore and Hong Kong.  Matt is recognised by Who’s Who Legal as a “Future Leader” among international arbitration practitioners in Asia-Pacific for 2023.

  1. Places at the Event are limited and will be allocated by the Organiser at its discretion based on various criteria and in order of priority upon receipt of registration and all payments due.

  4. No refunds will be made for cancellations or no-shows by registrants. However, a confirmed registrant who has paid the registration fees but does not turn up for the Event will be entitled to a set of the materials provided, if any.
  5. If any registrant is unable to attend the Event, an equivalent substitute may attend instead at no extra charge, provided that at least 3 days prior written notice is given to the Organiser. All such requests will be considered at the Organiser’s discretion and subject to any applicable top-upin fees.
