PRESIDENT'S MESSAGE - March 2017

The Singapore Institute of Arbitrators greeted 2017 with a flurry of activities.

SIArb continues to be blessed with the generosity of leading arbitrators sharing their knowledge through the SIArb platform. In a January 2017 seminar moderated by Mr Francis Goh, Mr David Bateson and Ms Marion Smith QC teased the audience with questions on the continuing viability of arbitration in the seminar, "Is the End of the Arbitration World Coming in 2017?" I trust it is not, well at least not this year. That was followed by a stimulated "Tylney Hall-styled” session presented by Dr Michael Hwang, SC and Prof Lawrence Boo in February 2017, where the two Singapore lights exchanged views on a range of prickly arbitration issues. Third Party Funding in Singapore – Perspectives on Best Practices (14 March 2017)

Third-party funding in dispute resolution proceedings has historically been received with scepticism due to the laws relating to champerty and maintenance.  The introduction of the Civil Law (Amendment Act) and the Civil Law (Third-Party) Funding Regulations 2017 breaks new ground by permitting third-party funding for international arbitrations in Singapore.

Training Program for The Institute of Modern Arbitration in Moscow (13 March 2017)

On 13 March 2017, the Institute hosted a full-day arbitration training workshop for a group of senior arbitration lawyers from Russia. The Russian visitors were on this island for a few days on a goodwill and education mission to explore matters relating to international arbitration practice in Singapore.

Over 50 participants attended the "Tylney Hall-styled" dialogue session between two heavyweights in the arbitration scene, Dr Michael Hwang S.C. and Professor Lawrence Boo. The speakers shared their views and experiences on a wide range of current arbitration issues, from the role of interrogatories in the discovery process in arbitration, settlement agreements in arbitrations and even to conflict of laws issues in the enforcement of arbitral awards.
