PRESIDENT'S MESSAGE - September 2020

In the blink of an eye, we find ourselves in the last quarter of 2020.  History will define us through our response to this challenging year.  The Arbitration community has certainly risen to the occasion by adapting quickly to remote hearings and webinars.  For the first time, SIArb will be conducting its entry and fellowship courses completely online this quarter. 

While we all long to see the back of Covid-19, there is no doubt we have learnt much about how to be productive with new technology.  Zoom is now the new normal for me and I confess I had grossly underestimated how effective such technology can be.  There is however no substitute for being able to meet all of you in person.  We will no doubt miss the Annual Symposium at the Old Parliament House and our Annual Dinner.  Next year, SIArb will be celebrating its 40th anniversary.  Let us keep our fingers crossed that we may all gather to celebrate together.

Nevertheless, prepare to mark your diary as we are launching an exciting new lecture series, “Beyond Arbitration – Global Perspectives”.  We are extremely privileged and honoured to have Professor Tommy Koh deliver a lecture titled “UN at 75: Quo Vadis?”.  This is certainly a milestone event that you will not want to miss.  Details can be found in our event calender.

The Ministry of Law (“Minlaw”) continues to be proactive in making legislative changes aimed at enhancing Singapore’s status as global leader in International Arbitration.  On 1 September 2020,  Minlaw proposed amendments to the International Arbitration Act in Parliament.  The Bill introduces a default mode of appointment for arbitrators in multi-party arbitrations where the agreement is silent on a mode of appointment.  Secondly, the Bill recognises that an Arbitral Tribunal and the Singapore Court has powers to enforce confidentiality obligations in an arbitration.

I look forward to meeting you in person again soon.  Meanwhile, let’s stay safe, take care of our loved ones and our neighbours.
