About the Seminar:

Maritime arbitration and general commercial arbitration exist within the same legal framework or curial law, but there are specialised rules customised for maritime arbitration.
In this seminar, we explore the changes brought about by the LMAA Rules 2017. The panelists will draw comparisons between ad hoc maritime arbitrations and those conducted under the LMAA Rules, the SCMA Rules and the SIAC Rules.
In addition, there will be discussions on whether there is a set of unspoken rules, or culture, that sets maritime arbitration apart from commercial arbitration.

About the Speakers:

Mr. Andrew G Moran QC is a senior English Queen’s Counsel appointed in 1994. He is now a full-time arbitrator, having ceased practice as counsel in 2017 in order to concentrate on his role as an international arbitrator. He is also a former Deputy High Court Judge in England and Wales. Through over 40 years in practice (24 years in silk), he has acquired extensive experience in civil, maritime and commercial litigation and arbitration. Andrew still sits at first instance and as an occasional Judge of Appeal in the Isle of Man, and has tried a range of heavy commercial, maritime and banking cases. He has also presided as the Chairman of specialist market tribunals of the International Petroleum Exchange, the International Commodities Exchange, and as legal adviser to the Tribunal at the London International Financial Futures Exchange in the City of London.In 2016, Andrew assumed residency in The Arbitration Chambers, focusing his extensive experience in dispute resolution as an independent arbitrator based in Singapore but arbitrating in Asia, the Middle East and Europe.
 
Mr. Prem Gurbani has been in continuous practice since being admitted to the Singapore Bar in January 1978. He has practiced in litigious and non-litigious aspects of commercial law, maritime law, commodity disputes and insurance law. In 1989, Prem founded Gurbani & Co. Prem has acted as Arbitrator or as Counsel for nearly twenty years in arbitrations held under the Rules of the LMAA (London Maritime Arbitrations Association), GAFTA (Grain and Feed Trade Association, London), FOSFA (Federation of Oils, Seeds and Fats Association Ltd, London), ICC (International Chamber of Commerce), PORAM (Palm Oil Refiners Association of Malaysia), SIAC (Singapore International Arbitration Centre) and the SCMA (Singapore Chamber of Maritime Arbitration). In 2012, Prem became a Consultant in Gurbani & Co. thereafter focusing on arbitrating maritime, commodity and insurance disputes. He was previously a Director of the Singapore Chamber of Maritime Arbitration and is presently a Director of the Singapore Maritime Foundation.

About the Chairperson:

  Mr. Lawrence Teh is a Senior Partner in the Litigation and Dispute Resolution practice and Arbitration practice since January 1999. He advises clients in all areas of commercial law and appears regularly as lead counsel in the Singapore courts, in arbitration, mediation and other forms of dispute resolution. He is also considered and appointed regularly as an arbitrator in international disputes under the rules and auspices of many international arbitration institutions and also in ad hoc arbitrations. He is particularly noted for his work on jurisdictional issues in international arbitration and litigation. He has particular experience in handling disputes in international trade and commodities, maritime and aviation, banking and financial services, onshore and offshore construction, mergers acquisitions and joint ventures and insurance. He is named in numerous legal guides and directories including the The Legal 500 Asia Pacific, Asialaw and Who’s Who Legal.
